1. Cancellation policy and right

Right of withdrawal

The customer is granted a right of withdrawal under the following conditions.

The customer can withdraw from the contract in writing at any time until the beginning of 24 hours before the agreed rental period.

inform by means of a clear statement (e.g. a letter, fax or e-mail) of your decision to revoke this Agreement. You can use the attached model withdrawal form, which is not mandatory.

In order to safeguard the withdrawal period, it is sufficient that you send the notification about the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal

If the cancellation takes place up to 24 hours before the start of the date on which the agreed rental period begins, the cancellation is free of charge for the customer.

If the withdrawal is made later, the customer must pay Parkda24 50% of the agreed fee. The customer is free to prove that Parkda24 has incurred no damage or less than the requested cancellation fee. The amount of damages shall be:
the maximum amount of the agreed fee.

Legal rights of withdrawal and termination of the parties remain unaffected by the above provisions.

2. Contract conclusion

The contract between you and Parkda24 is concluded in accordance with the general provisions of civil law. The website of Parkda24 at www.parkda24.de and the contents offered there do not constitute a binding offer to conclude a contract that you could accept. Book on the website www.parkda24.de a service, your declaration is the offer to conclude a contract. The contract is concluded by confirmation of the conclusion of the contract by Parkda24.

The contract can be revoked by you in accordance with the information set out under 1 above if you act as a consumer in accordance with § 13 BGB when concluding the contract. Consumers in accordance with § 13 BGB are persons who conclude the contract for one or more purposes, which for the most part cannot be attributed to their commercial or independent professional activity.

2.1 Individual agreements

If you have concluded agreements with a representative of Parkda24 regarding the services, the required prices or the circumstances of the provision of services (including liability), these agreements take precedence over the regulations provided for in these GTC.

2.2 Representatives of Parkda24

Other persons employed by Parkda24, in particular persons employed by Parkda24 on the premises at Willhelm-Fay-Str. opposite 30 ("Flurscheidweg") ("the premises"), have only the following powers of representation for Parkda24:

3 Benefits

If you have not concluded an individual agreement in accordance with 2.1 of these GTC, Parkda24 provides the services in accordance with the service description of Parkda24 and this clause 3 of the GTC. In this case, the terms of service become part of the contract.

3.1 Services of Parkda24

3.1 The obligations of Parkda24 are described in the service description for the respective subject matter of the contract. The subject matter of the contract is either the service "Parking" or the service "Valet Service".

have been agreed, the provisions of the service description and the provisions of these GTC apply.

3.2 Your services

You are obliged to participate in the services of Parkda24 in accordance with this provision:

3.2.1 Approval and ability to drive of your car

For all services according to the specifications, it is a prerequisite that your car is approved and capable of driving for the duration of the service in accordance with the regulations of the Road Traffic Authorization Ordinance. This includes in the case of the service "parking space" the entire duration of the parking of the car on the premises, in the case of the service "Valet Service" the period from collection to provision of your car.

You undertake to ensure the approval and ability to drive of your car to the above-mentioned extent. Excluded from this obligation are damages caused culpably by Parkda24 or vicarious agents of Parkda24.

You are obliged to hand over a car key to Parkda24 when using the "Valet Service" service, which enables you to open and drive your car, as well as the registration certificate Part II. If you use the "parking space" service, you are obliged to hand over a car key to Parkda24 on request, which enables the opening and driving of your car. Parkda24 will move your car within the framework of the service "parking space" only on the company premises and within the framework of the service "Valet Service" only on the company premises and when collecting and providing your car. You are obliged to give your consent to this.

3.2.2 Authorisation to dispose

You are obliged to ensure that you can use the services of Parkda24 with your car, also with regard to the rights of third parties.

3.2.3 Safety of your car

You are obliged to ensure that your car does not pose any environmental hazards. In particular, you are obliged to ensure the leakage and leakage safety of your car with regard to fuels, coolants, hydraulic fluids and cleaning fluids. You are obliged to check the electrical safety and safety against fire hazards of your car and to ensure that your car does not cause any fires and does not pose any electrical hazards.

3.2.4 Conduct on the premises

The organisation of races on the premises is prohibited. A maximum speed of 10 km/h shall apply on the premises. They are obliged to comply with this maximum speed. Furthermore, you are obliged to follow the signs placed as traffic advice. You are obliged to move your vehicle on the premises in such a way that property and persons are not damaged or injured due to your fault. The regulations of the Road Code on the regulation of traffic – e.g. right of way, traffic advice, etc. – apply accordingly.

As part of the use of the "parking space" service, you are obliged to park your car exclusively in the assigned parking space. Several parking spaces, traffic areas or other areas of the company premises may not be used for parking your vehicle, subject to another individual agreement.

3.2.5 Excluded objects and actions

It shall be prohibited to move the following objects to the premises:

explosives
Weapons
Narcotics
Animals or plants of protected species
Radiating substances or chemical hazardous substances
Substances whose storage requires a special administrative permit
Non-marketable articles
Articles stolen or stolen
Articles subject to, or for which the police seizure or customs seizure may be ordered
Unpaid goods
Fuel in a quantity exceeding the fuel tank capacity of the passenger car plus 10l
for fire hazards, alcohol in a quantity exceeding 5 litres of pure alcohol
Butane gas, propane gas, hydrogen, oxygen, acetylene, chlorine gas, carbon dioxide or other gases stored under pressure
Chemical reagents posing a hazard to property and/or humans.

The whereabouts of passengers in parked cars – people or animals – are prohibited. Parkda24 is entitled to provide state authorities with access to the car.

3.2.6 No subletting

You are not entitled to provide the car park by subletting third parties, a corresponding permission is refused by Parkda24.

3.2.7 Taking over of the car at the end of the rental period

You are obliged to pick up your car at the company premises at the end of the agreed rental period and remove it from the company premises. In the event of delays, you are obliged to inform Parkda24 of your delay and to inform us of your planned arrival. Parkda24 is entitled, after expiry of the rental period, to remove your car from the company premises and to charge them in addition to a Compensation fee of 100,00 euros calculated. Otherwise, by agreement Exceeding the rental period Compensation for damages 15,00 Euros per day are calculated.

4. Charges

For the use of the services you are obliged to pay the agreed fees. Parkda24 has a published price list that is updated regularly. As far as no individual agreements ag. Clause 2.1 of these GTC, the prices published in the price list apply to the services used.

4.1 Due date when booking with Parkda24

Have you booked the website www.parkda24.de serviced or concluded the contract with Parkda24 without using another provider, your payment obligations will be due as follows:

4.2 Due date when booking with another provider

The maturity depends on your agreement with the respective other provider.

4.3 Delay

If you default on your obligations towards Parkda24, Parkda24 is entitled to assert the legal consequences of default.

4.4 Lien

Parkda24 is entitled to assert the statutory right of retention and the statutory lien on account of the claims of Parkda24 from the tenancy of your car. In the event of default or if you and the holder can no longer be determined, Parkda24 is entitled to use the lien according to the statutory provisions, but at the earliest 6 weeks after the threat of use of the lien.

5. Cancellation

In addition to your right of withdrawal, Parkda24 grants you the right to cancel a booked service. Cancellation shall be effected by e-mail or fax by notification of the cancellation and the information identifying the order to:

6. Liability Parkda24

6.1 Liability according to the statutory provisions

The use of services and other offers of Parkda24 is at the customer’s own risk.

Parkda24 is liable under the statutory provisions for

the intentional or grossly negligent breach of obligations of Parkda24;
the injury to life, body and health due to fault of Parkda24;
the liability conditions of the Product Liability Act;
the delay of Parkda24 if a delivery date has been fixedly agreed;
breach of a warranty given by Parkda24;
the non-achievement of an agreed performance success brought about by Parkda24;
the occurrence of a procurement risk that Parkda24 has assumed.

Parkda24 is liable in accordance with the statutory provisions for damages caused by intent or gross negligence of Parkda24 as well as by intent
or gross negligence of the representatives or agents of Parkda24. If the customer is an entrepreneur, the liability of Parkda24 in the event of gross negligence is limited to the foreseeable, typically occurring damage at the conclusion of the contract.

– Parkda24 is liable in accordance with the statutory provisions if Parkda24 culpably violates an essential contractual obligation. In this case, the liability of Parkda24 is limited to the foreseeable, typically occurring damage.

– Liability for culpable injury to life, body or health shall remain unaffected; This also applies to mandatory liability under the Product Liability Act, strictly independent legal liability as well as claims of the customer that have already arisen before the conclusion of the contract.

– Unless otherwise regulated above, the liability of Parkda24 is excluded. In particular, it should be noted that Parkda24 is not liable for glass damage to the customer's vehicle. Minor damage to the vehicle is not documented before the vehicle is handed over, so that here also a liability of Parkda24 is excluded. In this respect, it is the responsibility of the customer to document minor damage to the vehicle before handing over the vehicle to Parkda24 (by photo or similar).

– Der Kunde haftet unabhängig von einem Verschulden für alle Schäden, die infolge technischer Defekte durch das von ihm oder von ihm beauftragte Dritte auf das Betriebsgelände von Parkda24 verbrachte Fahrzeug verursacht werden.

– Der Kunde tritt bereits jetzt eigene Ansprüche gegen Dritte oder Versicherungen aus einem von ihm zu vertretenden oder aufgrund eines technischen Defekts des Fahrzeugs eingetretenen Schadensfall im Voraus an Parkda24 ab, soweit Parkda24 ein Schaden entstanden ist.

Parkda24 haftet zudem nicht für Brandschäden oder Diebstahl des Fahrzeuges während der vereinbarten Parkdauer.

In keinem Fall haftet Parkda24 für Schäden am Fahrzeug, die durch Unwetter, wie Hagelschäden, Tornados, Erdbeben, Flutkatastrophen und jede weitere Umweltkatastrophe entstanden sind.

In keinem Fall haftet Parkda24 für den Fahrer bzw. Kunden auf dem Parkplatzgelände verursachte Unfälle mit Sach- und /oder Personenschäden.

Für Schäden, die während der Autofahrt passieren, die der Umwelt zu Schulden kommen, haftet nicht Parkda24, wie z.B. Reifenschaden, die durch Nägel oder Steinschlag entstehen.

Das Abstellen des Fahrzeuges auf einem der von Parkda24 bereitgestellten Parkplätze erfolgt ausschließlich auf Gefahr des Kunden.

Parkda24 haftet nicht für Gegenstände im Fahrzeug, insbesondere Bargeld, Banknoten, Urkunden etc, die der Kunde im Fahrzeug zurücklässt,
auch nicht im Valet-Service.

Bei Schäden, die in der Serviceleistung Hol- und Bring Service (Valetparking) am Frankfurt Flughafen getätigt werden, sind bei jeglichen Schadenfällen ausschließlich über die Haftpflichtversicherung des Fahrzeugbesitzers zu agieren.

Parkda24 haftet nicht für Gegenstände, insbesondere Bargeld, Banknoten, Urkunden etc. die der Kunde im Fahrzeug zurücklässt.

Der Kunde haftet für vorsätzlich oder fahrlässig verursachte Schäden an Rechtsgütern von Parkda24 oder Dritter auf dem Betriebsgelände von Parkda24 sowie für Schäden, die durch von ihm auf das Betriebsgelände von Parkda24 verbrachte Personen oder Sachen verursacht werden.

Unabhängig vom Verschulden haftet der Kunde für alle Schäden, die infolge technischer Defekte durch das von ihm oder von ihm beauftragte Dritte auf dem Betriebsgelände von Parkda24 verbrachte Fahrzeug verursacht werden (z.B. Ölverlust, Explosion). Dies gilt auch dann, wenn derartige Defekte nicht in dem Zustandsbericht über das Fahrzeug aufgenommen worden sind oder bislang unbekannt waren.

Das Abstellen des Fahrzeuges auf einem der von Parkda24 bereitgestellten Parkplätze erfolgt ausschließlich auf Gefahr des Kunden. Parkda24 übernimmt keinerlei Haftung für den Fall, dass an einem abgestellten PKW während der Parkdauer ein Schaden verursacht wird. Parkda24 haftet zudem nicht für Brandschäden oder Diebstahl des Fahrzeuges während der vereinbarten Parkdauer. In keinem Fall haftet Parkda24 für vom Fahrer bzw. Kunden auf dem Parkplatzgelände verursachte Unfälle mit Sach-und/oder Personenschäden. Parkda24 übernimmt darüber hinaus keine Haftung für Schäden an Gepäckstücken des Kunden, die auf dem Firmengelände oder im Verlauf des durchgeführten Shuttle-Service auftreten.

Parkda24 übernimmt keine Haftung bei der Abgabe von Schlüsseln durch den Kunden, sowie keinerlei Haftung für Schaden am Fahrzeug, Verlust, Diebstahl oder Beschädigungen.

6.2 Sonstige Haftung

Soweit Parkda24 nicht bereits nach der vorstehenden Ziffer 6.1 haftet, haftet Parkda24 für die Verletzung einer Vertragspflicht, deren Erfüllung den Vertrag prägt und auf deren Erfüllung Sie vertrauen dürfen – dies beinhaltet insbesondere die in der Leistungsbeschreibung beschriebenen Hauptpflichten von Parkda24 – der Höhe nach beschränkt auf die bei Vertragsschluss vorhersehbaren und vertragstypischen Schäden.

6.3 Erfüllungsgehilfen

Parkda24 haftet nach den vorstehenden Bestimmungen auch für das Verhalten der Erfüllungsgehilfen von Parkda24, insbesondere für deren Verschulden.

6.4 Haftungsausschluss

Soweit Parkda24 nicht nach den vorstehenden Ziffern 6.1 bis 6.3 haftet, ist die Haftung von Parkda24 ausgeschlossen.

Ebenso stellt der Kunde Parkda24 frei, bei Schäden höherer Gewalt sowie bei Schäden durch innere und äußere Unruhen, Kriegsereignisse und elementare Naturkräfte. Ein Ersatzanspruch des Kunden auf Minderung oder Schadenersatz entfällt dann, wenn dieser den Schaden zwecks Schadensfeststellung nicht unverzüglich und noch vor Verlassen des Betriebsgeländes dem Aufsichtspersonal gemeldet hat. Parkda24 haftet nicht für Beschädigung und Zerstörung von Kraftfahrzeugen einschließlich deren Inhalte und Ladungen, die durch Handlungen Dritter, z. B. durch andere Mieter oder sonstigen Personen, verursacht worden sind. Dies gilt auch für Entwendungen und Abhandenkommen von Kraftfahrzeugen, Fahrzeugteilen, Fahrzeuginhalt und Fahrzeugladung (z. B. Autoradio, Autotelefon, persönliche Wertgegenstände, Computer, Fotoausrüstung, Sportausrüstung und ähnliches). Beschädigungen sind dem Personal
unverzüglich mitzuteilen.
Parkda24 ist mit größter Sorgfalt bemüht, den Kunden rechtzeitig zu einer mitgeteilten Abflugzeit zum Flughafen Frankfurt zu befördern. Die Rechtzeitigkeit der Ankunft ist nicht Vertragsgegenstand. Schadenersatzansprüche, insbesondere solche aus nicht erreichten Abflügen und sonstigen verpassten Terminen, sind ausgeschlossen

7. Mietvertrag, Valet- Service

Parkda24 bietet Fluggästen des Flughafens Frankfurt am Main die Möglichkeit, ihr übergebenes Fahrzeug auf dem von Parkda24 betriebenen Parkplatz (Willhelm-Fay-Str gegenüber 30 (Flurscheideweg 70) 65936 Frankfurt am Main) gegen Entgelt abzustellen und den von Parkda24 eingerichteten Valet-Service zum Flughafen Frankfurt am Main und zurück zu nutzen. Parkda24 ist mit größter Sorgfalt bemüht, das Fahrzeug des Kunden rechtzeitig zu einer mitgeteilten Abflugzeit zum Flughafen zu befördern. Die Rechtzeitigkeit der Ankunft am Flughafen ist jedoch kein Vertragsgegenstand. Daher übernimmt die Parkda24 keine Haftung für die rechtzeitige Verbringung der Fahrzeuge des Kunden zum Flughafen Frankfurt. Eine Haftung für Schäden am Fahrzeug bei Nutzung des Valet-Service ist ausgeschlossen.

Mit der Annahme einer Stellplatz-Buchungsanfrage durch Parkda24 kommt zwischen dem Kunden und Parkda24 ein Mietverhältnis zustande. Weder Bewachung noch Verwahrung sind Gegenstand dieses Vertrages. Parkda24 übernimmt keine Obhut oder besondere Fürsorgepflichten für die von dem Kunden eingebrachten Sachen.

Parkda24 ist verpflichtet, dem Kunden für die vereinbarte Dauer den bzw. die gebuchten Stellplätze zur Verfügung zu stellen. Es besteht kein Anspruch
des Kunden auf einen bestimmten Stellplatz zu stellen, es sei denn es handelt sich um eine Dauermiete, so wird dem Kunden ein fester Parkplatz zugewiesen.

Parkda24 steht wegen ihrer Forderungen aus dem Mietvertrag ein Zurückbehaltungsrecht sowie ein gesetzliches Pfandrecht an dem eingestellten Fahrzeug des Kunden zu. Entfernt der Kunde das Fahrzeug nach Ablauf der Mietzeit nicht, so tritt keine stillschweigende Verlängerung des Mietverhältnisses auf unbestimmte Zeit ein (Ausschluss der Fiktion des §545 BGB). Parkda24 kann in diesem Fall für die Dauer bis zur Entfernung des Fahrzeugs eine Entschädigung in Höhe des Entgeltes verlangen, das für eine entsprechende Mietdauer unter Zugrundelegung des für die Mietzeit vereinbarten Entgelts verlangt werden könnte; die weiteren Ansprüche von Parkda24 bleiben hiervon unberührt. Insbesondere ist Parkda24 berechtigt, das Fahrzeug nach Ablauf der Mietzeit vom Betriebsgelände von Parkda24 auf Kosten des Kunden zu entfernen oder entfernen zu lassen. Andernfalls wird nach Absprache für eine Überschreitung der Mietzeit Schadenersatz in Höhe von 15,00 Euro pro Tag berechnet werden. Parkda24 kann die Herausgabe des eingestellten Fahrzeuges ohne vorherige Zahlung des Rechnungspreises verweigern.

Valet Service: Das Kundenfahrzeug wird durch einen Mitarbeiter von Parkda24 am Flughafen- Terminal am vereinbarten Ort entgegengenommen und auf dem Betriebsgelände oder vom Betriebsgelände zum Flughafen an den vereinbarten Ort gebracht. Voraussetzung dafür ist, dass das abgestellte Fahrzeug verkehrssicher, haftpflichtversichert, mit einem amtlichen Kennzeichen und mit einer gültigen amtlichen Prüfplakette versehen ist. Andernfalls ist Parkda24 berechtigt, die Annahme des Fahrzeuges zu verweigern und der Kunde bleibt zur Zahlung der vereinbarten Vergütung verpflichtet. Zudem wird empfohlen, den Ersatzschlüssel des Fahrzeuges mitzunehmen.

Bei der Übernahme bzw. Rückgabe während unserer Nachtzeiten wird dem Kunden ein Nachtzuschlag von 40€ berechnet. Sollte der Kunde bei seinem Abflug, sowie bei seiner Rückgabe in unseren Nachtzeiten den Service Parkda24 benötigen, wird dieser Zuschlag nur einmal berechnet. Die Nachtzeiten von Parkda24 sind von 21:00 Uhr bis 06:00 Uhr.

Da Parkda24 mehrere Parkflächen im Raum des Flughafen Frankfurt besitzt, kann die gefahrene Kilometerzahl aufgrund dieser Tatsache bzw. bei Vollbelegung durch das Durchführen von Umparkmaßnahmen von der angegebenen Kilometerzahl auf unserer Website abweichen. Eine gefahrene Kilometerzahl von höchstens 40 km liegt hier im Toleranzbereich und ist vom Kunden zu akzeptieren.

8. Ihre Haftung

Ihre Haftung richtet sich nach den gesetzlichen Bestimmungen.

9. Streitbeilegungsverfahren

Parkda24 nimmt nicht an einem Streitbeilegungsverfahren teil.
